Agreement

The terms and conditions in HOWCO's forms and acknowledgements are incorporated to constitute the entire and exclusive agreement between customer and HOWCO, INC.

Registration

All HOWCO, INC. online customers will be required to register in order to place an online order. Once you have established an account and it has been approved, you will have the ability to use your account. To check the status of your registration, contact us via our website or e-mail with your name, location, and contact information.

Prices

Effective per date of price list, prices listed are wholesale and do not include freight, handling fees, or taxes and may be changed without notice. Customers are responsible for all applicable taxes.

Payment Terms

For customers with an established HOWCO, INC. account online, you will be able to purchase and pay online by credit card. For customers with established credit, payment terms are due upon receipt of invoice. If the customer fails to pay, HOWCO, INC. may refuse to ship further products until payments are made or cancel any unshipped orders.

Any credit balance issued will be applied within one (1) year of its issuance. Credit is subject to cancellation if not applied or requested within one year. Contact our Accounting division to apply any outstanding credits at 1-800-633-3912 or you can also call (704) 731-2063.

A 25% deposit is required with any purchase orders for equipment. The order will not go into production until the deposit is received.

Unless prohibited by law, the Seller shall pay all federal, state or local tax, transportation tax, or other tax which is required to be imposed upon the items ordered hereunder, or by reason of their sale or delivery; the Order price shall be deemed to include such taxes.

Substitution

Products may be substituted and may not always match exactly to online descriptions and/or images. For specific questions regarding any item, we have technical assistance available. Simply log in, click on Contact Us on our website and send in your questions or concerns. We will make every effort to respond within 48 hours.

Availability

Certain products may not be available for sale in all areas. In the instance that we are not able to sell to you due to your shipping location, we will refer your order to our regional distributor. In the event of a backorder, short-ship or shipping error, HOWCO, INC. will arrange for the equipment to be shipped to your location as soon as possible. HOWCO, INC. shall not be held responsible for any delay in or impairment of performance resulting from and not limited to, Acts of God, shortage, inability to procure product, severe weather conditions, or any other circumstances beyond HOWCO, INC.'s control.

Cancellation or Return

Any cancellations must be approved by HOWCO, INC. and are subject to restocking fees. Proof of purchase is required. Products must be returned within 30 days of purchase in order to receive full credit. If parts are returned after 30 days, a restocking fee will be applied as following:

Within 30 days: Full Credit

30-60 days: 25% Restocking Fee

60-90 days: 50% Restocking Fee

90-120 days: 75% Restocking Fee

120+ days: No Credit Given

HOWCO, INC. will make every effort to correct or adjust any issues in respect to the product, which proves to be defective within warranty period. Contact HOWCO, INC. via website giving date and number of original invoice, and describing the defect. Often times, the manufacturer warrants their products and copies of such warranties can be made available free of charge to customers upon their request. Please send such requests via website and include the stock number, the manufacturer's model number (if shown) of each product, along with a mailing address, fax number, and/or e-mail address.

Orders canceled after assembly has commenced are subject to a minimum 20% cancellation charge or incurred costs, whichever is higher. All merchandise returned without authorization will be refused and returned, subject to a 20% restocking fee.

Claims

Merchandise shipped to our customers becomes the property of the buyer upon receipt by the carrier. Make sure to properly inspect all products that are received and to ensure no damages or defects. If damage is discovered after receipt, contact the carrier immediately so that a claim may be filed against the carrier. In all cases, the buyer must file the claim.

Product Information

Material Safety Data Sheets (MSDS) for OSHA defined hazardous substances are available to customers. The information and recommendations included within these sheets are for the customer's use and HOWCO, INC. disclaims any and all liability to any user.
